Terms of Service

By creating a Neferos account, forwarding a phone number to Neferos, or otherwise using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not access or use Neferos.

Neferos is an agentic AI receptionist platform. The Service answers inbound and outbound voice calls, books and manages appointments, captures and qualifies leads, sends SMS and email follow-ups, integrates with connected calendars and CRMs, and provides analytics — operating autonomously on behalf of your business.

Neferos uses third-party providers — including Twilio for telephony and SMS, Google for calendar synchronization, Stripe for payments, and AI and speech providers for transcription, voice, and conversational reasoning.

We may add, change, or remove features at any time. We may also limit or suspend usage that exceeds your plan's call or SMS allowances until your next billing cycle or until you upgrade.

You must be at least 16 years old and authorized to act on behalf of the business you register. You agree to provide accurate business information and to keep your account credentials secure.

You are responsible for all activity under your account and for the content and configuration you create, including AI greeting scripts, business hours, transfer numbers, and campaign messages.

You are solely responsible for ensuring that your use of Neferos complies with all applicable laws and regulations, including telemarketing, call-recording, SMS consent (TCPA), and consumer-protection laws in the jurisdictions where your callers are located.

You must obtain any consent required by law before recording calls or sending SMS messages. When you enable call recording, Neferos discloses recording to callers in the AI greeting, but the legal obligation to obtain valid consent remains yours.

You may not use Neferos to send unsolicited messages, to contact numbers on a Do-Not-Call list, to deceive or harass callers, to transmit unlawful content, or to violate the rights of any person.

For outbound campaigns, you confirm prior express written consent (and the absence of DNC entries) for every number on the campaign list before any dial is placed.

You grant Neferos a limited license to process caller information — including phone numbers, transcripts, and recordings — solely to provide the Service. Neferos stores and processes this data to answer calls, book appointments, and generate insights for your business.

If you operate in a regulated environment (for example, healthcare subject to HIPAA), you are responsible for enabling Neferos's HIPAA mode and configuring the Service to meet your compliance obligations. You are responsible for any business associate agreement or similar arrangement required for your use case.

Paid plans are billed in advance on a recurring (monthly or annual) basis through Stripe. Plan pricing, call limits, and features are displayed on your billing page and at sign-up.

Usage (calls, SMS, appointments) is measured per billing cycle. If you exceed your plan's included allowance, additional consumption may be billed or restricted according to your plan.

Fees are non-refundable except where required by law. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. We may change our fees with at least 30 days' notice.

From time to time we may offer trial or promotional pricing. Trials and promotions are limited in time and scope, and automatically convert to the standard plan rate at the end of the trial or promotional period unless you cancel beforehand.

The Service integrates with third-party platforms (Google Calendar, Twilio, Stripe, and others). These services are governed by their own terms and policies. Neferos is not responsible for the availability, accuracy, or behavior of third-party services, and your use of them is subject to their respective terms.

Neferos and its software, branding, prompts, and features are owned by us and our licensors. These Terms do not grant you any right to our trademarks, source code, or other proprietary content beyond the limited right to use the Service.

You retain ownership of your business data. By using the Service, you grant us the rights necessary to host, process, and transmit your data to deliver the Service to you.

Neferos is provided on an 'as is' and 'as available' basis. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that every call will be answered or appointment booked. AI-generated responses may occasionally be inaccurate; you are responsible for reviewing configuration and outputs.

To the maximum extent permitted by law, Neferos and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or business, arising out of or related to the Service — whether based on contract, tort, or any other theory — even if we have been advised of the possibility of such damages. Our aggregate liability for any claim is limited to the amount you paid us in the twelve months preceding the claim.

You agree to indemnify and hold Neferos harmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, your violation of applicable law (including telemarketing, recording, and consent laws), or your content and configuration.

You may cancel your account at any time. We may suspend or terminate your access if you breach these Terms, if your account is inactive, or to protect the Service or other users. Upon termination, your right to use the Service ends, and we may delete your data in accordance with our Privacy Policy.

We may revise these Terms from time to time. We will post the updated Terms on this page and, for material changes, provide notice through the app or by email. Your continued use of Neferos after changes take effect constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction there.

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Neferos regarding the Service.
